Read this before you pay anybody
A debt review listing cannot simply be made to disappear for a fee. The companies advertising that they can “clear” or “remove” your debt review for a payment are not telling you the full picture. Understand your route first — the money is usually gone before you find out it is not possible.
The three routes, and nothing else
These are the three broad pathways off the debt review register. Which one applies to you is a matter of fact, not of negotiation.
Before a court order
The applicable pre-order route depends on the stage of your application. In some cases your debt counsellor may be able to withdraw the matter; in others a different process applies. Either way it is decided by where your application actually sits, not by what you are willing to pay.

After a court order
Once a magistrate has made the restructuring an order, only a court can set it aside. That usually involves a rescission application, or an application showing that you are no longer over-indebted.

You finished the plan
When your restructured debts are paid up, your debt counsellor issues a clearance certificate (Form 19) and the credit bureaux are required to remove the debt review flag. Your home loan may remain in place provided it is up to date. This is not removal — it is completion, and it is the only route that leaves your record clean.

Rescission is a court application. Get an attorney.
We are registered debt counsellors, not attorneys, and we will not describe a do-it-yourself rescission because doing so would be legal advice we are not registered to give. What we can do is tell you which side of the court-order line you are on, which is the thing that decides everything else.
What leaving actually costs you
Removal does not reduce what you owe. It ends the protection, and your original agreements resume with any arrears and interest that built up. If you qualify for a clearance certificate instead, that is the opposite trade — you finish the plan and keep a clean record.

Why people want out
Four reasons account for almost all of it. Two of them have better answers than removal.
Your income recovered
You can service your original agreements again. Worth doing the arithmetic properly before acting on it.
You were never over-indebted
It may have been a rushed assessment, or a company that signed you up on a phone call.
You want to buy a house
You cannot take new credit under debt review, by law, until your clearance certificate is issued. Worth knowing how far off that you actually are.
You are unhappy with your counsellor
That is a reason to switch counsellor, not to leave debt review. Switching keeps the protection and the plan.

View all FAQs →How long does a clearance certificate take?
Usually 7 to 21 business days from the point where your debts are paid up and all the paid-up letters are in, for your debt counsellor to issue the Form 19 clearance certificate. The credit bureaux must then update your profile within about 7 business days of receiving it. The waiting is mostly on the paid-up letters from your credit providers, not on the certificate itself.
Can a lawyer remove me from debt review?
An attorney can bring the court application where one is needed, but instructing a lawyer does not by itself change which route applies to you. That is decided by a fact: whether a magistrate has already granted an order. What is a rescission?
A rescission is an application asking a court to set aside an order it previously granted. Where your restructuring has been made an order of court, that order stands until a court sets it aside, which is why this route needs an attorney and can be refused. We are registered debt counsellors and not attorneys, so we will tell you whether you are on this side of the line, but we will not describe how to run the application.
Can I buy a house after debt review?
Yes, once you have your clearance certificate and the bureaux have removed the debt review flag. You cannot take on new credit while you are under debt review — that restriction is in the National Credit Act, not a lender's policy. If a bond is the reason you want out, it is worth finding out how close you are to completion first, because completing is usually faster than a court application.
Is debt review removal a scam?
Debt review removal itself is not a scam — there are genuine routes off the register. What is a scam is the promise that a listing can be made to disappear for a fee. No payment changes whether a magistrate has granted an order, and that single fact decides which route you have. Anyone offering to “clear” or “remove” your listing for money is selling something they cannot deliver.
Can a company remove my listing for a fee?
No, and anybody who says otherwise is selling you something they cannot deliver. There are exactly three routes off the register — withdrawal before an order, rescission by a court, or a clearance certificate on completion — and a payment to a third party is not one of them.
How long does it take?
A withdrawal before a court order is quick, usually a matter of weeks once your counsellor lodges it. A rescission is a court application and runs to months. A clearance certificate is issued when the plan finishes.
What happens to my debts afterwards?
They come back on their original terms, plus any arrears and interest that accumulated. This is the part people are not told. Leaving debt review does not reduce what you owe — it removes the restructured payment and the protection.
Will my credit record be clean?
Only after a clearance certificate. A withdrawal or rescission removes the debt review flag, but the underlying account histories — including any arrears — remain on your record for their normal retention periods.
Can I just stop paying?
No. Stopping payments does not remove you; it leaves you under review and in arrears, and a credit provider may terminate the review under section 86(10) and proceed against you directly. It is the worst of both positions.
Can I switch counsellor instead?
Yes, and it is a completely different, much simpler step that keeps your protection and your plan intact. If your complaint is about service rather than about debt review itself, that is the route to look at.
